1. Introduction

These Terms of Service ("Terms") govern the relationship between Vardhman Green Park Apartment Rahwasi Rakhrakhav Sahkari Samiti Maryadit, Bhopal ("the Society", "we", "us", or "our") and the residents ("you" or "members") of Vardhman Green Park Apartments. By residing in the society premises and availing of our services, you agree to be bound by these Terms.

2. About the Society

Vardhman Green Park Apartment Rahwasi Rakhrakhav Sahkari Samiti Maryadit is a registered cooperative housing society under the laws of Madhya Pradesh, India, located in Bhopal. The society is responsible for the maintenance and upkeep of common areas and the provision of essential services to all residents.

3. Services Provided

The Society provides the following basic maintenance services to its residents:

Cleaning and Sanitation – Regular cleaning and sanitation of all common spaces including corridors, staircases, lobbies, and parking areas.
Lift Maintenance – Regular servicing and maintenance of common lifts to ensure safe and reliable operation.
Common Area Lighting – Maintaining proper lighting in all common areas including corridors, staircases, parking, and outdoor pathways.
Community Park Maintenance – Upkeep and maintenance of the community park including trimming of trees and grass and cleanliness of green spaces.
Water Supply – Ensuring regular and adequate supply of water to all residential units.
Security Services – Round-the-clock security guard stationed at the society gate.

4. Membership and Maintenance Charges

All residents of Vardhman Green Park Apartments are required to pay maintenance charges as determined by the society's governing body. Maintenance charges may be paid on a monthly, half-yearly, or yearly basis. These charges fund the essential services listed above. The amount of maintenance charges may be revised from time to time as decided by the society's general body meeting.

5. Payment Terms

Maintenance charges may be paid on a monthly, half-yearly, or yearly basis, and must be paid by the due date specified by the Society for the chosen payment cycle. Failure to pay maintenance charges on time may result in penalties as per the society's bylaws. The Society may collect payments through various modes including online payment, bank transfer, or cash.

6. Obligations of Residents

Residents are expected to:

Pay maintenance charges promptly and on time.
Use common facilities responsibly and with care.
Follow the rules and regulations laid down by the society.
Not cause damage to common areas or property.
Maintain decorum and respect the rights of fellow residents.
Cooperate with the society management for the smooth functioning of services.

7. Limitation of Liability

The Society makes reasonable efforts to provide all listed services in a timely and efficient manner. However, services may be temporarily disrupted due to circumstances beyond our control, including but not limited to natural disasters, government orders, equipment failure, or supply shortages. The Society shall not be held liable for any inconvenience or loss arising from such disruptions.

8. Amendments

The Society reserves the right to amend these Terms from time to time. Any changes will be communicated to residents through appropriate channels such as notice boards, society meetings, or electronic communication.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, specifically the Madhya Pradesh Cooperative Societies Act and other applicable legislation. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts in Bhopal, Madhya Pradesh.

10. Language Disclaimer

These Terms of Service are provided in both English and Hindi for the convenience of residents. In the event of any discrepancy or difference in meaning between the English version and the Hindi version, the English version shall prevail and be considered the authoritative text.

1. परिचय

ये सेवा की शर्तें ("शर्तें") वर्धमान ग्रीन पार्क अपार्टमेंट रहवासी रखरखाव सहकारी समिति मर्यादित, भोपाल ("समिति", "हम", "हमारा") और वर्धमान ग्रीन पार्क अपार्टमेंट के निवासियों ("आप" या "सदस्य") के बीच के संबंध को नियंत्रित करती हैं। समिति परिसर में रहकर और हमारी सेवाओं का लाभ उठाकर, आप इन शर्तों से बाध्य होने के लिए सहमत हैं।

2. समिति के बारे में

वर्धमान ग्रीन पार्क अपार्टमेंट रहवासी रखरखाव सहकारी समिति मर्यादित भारत के मध्य प्रदेश राज्य के कानूनों के तहत पंजीकृत एक सहकारी आवासीय समिति है, जो भोपाल में स्थित है। समिति सामान्य क्षेत्रों के रखरखाव और सभी निवासियों को आवश्यक सेवाएँ प्रदान करने के लिए जिम्मेदार है।

3. प्रदान की जाने वाली सेवाएँ

समिति अपने निवासियों को निम्नलिखित बुनियादी रखरखाव सेवाएँ प्रदान करती है:

सफाई एवं स्वच्छता – गलियारों, सीढ़ियों, लॉबी और पार्किंग क्षेत्रों सहित सभी सामान्य स्थानों की नियमित सफाई और स्वच्छता।
लिफ्ट रखरखाव – सुरक्षित और विश्वसनीय संचालन सुनिश्चित करने के लिए सामान्य लिफ्टों की नियमित सर्विसिंग और रखरखाव।
सामान्य क्षेत्र प्रकाश व्यवस्था – गलियारों, सीढ़ियों, पार्किंग और बाहरी रास्तों सहित सभी सामान्य क्षेत्रों में उचित प्रकाश व्यवस्था का रखरखाव।
सामुदायिक पार्क रखरखाव – बागवानी, भूदृश्य और हरित स्थानों की स्वच्छता सहित सामुदायिक पार्क का रखरखाव।
जल आपूर्ति – सभी आवासीय इकाइयों को नियमित और पर्याप्त जल आपूर्ति सुनिश्चित करना।
सुरक्षा सेवाएँ – सोसाइटी गेट पर चौबीसों घंटे सुरक्षा गार्ड तैनात।

4. सदस्यता और रखरखाव शुल्क

वर्धमान ग्रीन पार्क अपार्टमेंट के सभी निवासियों को समिति की शासी निकाय द्वारा निर्धारित रखरखाव शुल्क का भुगतान करना आवश्यक है। रखरखाव शुल्क मासिक, अर्धवार्षिक या वार्षिक आधार पर भुगतान किया जा सकता है। यह शुल्क ऊपर सूचीबद्ध आवश्यक सेवाओं के लिए खर्च किया जाता है। रखरखाव शुल्क की राशि को समिति की आम सभा बैठक द्वारा समय-समय पर संशोधित किया जा सकता है।

5. भुगतान की शर्तें

रखरखाव शुल्क मासिक, अर्धवार्षिक या वार्षिक आधार पर भुगतान किया जा सकता है और चुने गए भुगतान चक्र के लिए समिति द्वारा निर्दिष्ट नियत तारीख तक भुगतान किया जाना चाहिए। समय पर रखरखाव शुल्क का भुगतान न करने पर समिति के उपनियमों के अनुसार जुर्माना लगाया जा सकता है। समिति ऑनलाइन भुगतान, बैंक ट्रांसफर, या नकद सहित विभिन्न माध्यमों से भुगतान एकत्र कर सकती है।

6. निवासियों के दायित्व

निवासियों से अपेक्षा की जाती है:

रखरखाव शुल्क का समय पर भुगतान करें।
सामान्य सुविधाओं का जिम्मेदारी से और सावधानी से उपयोग करें।
समिति द्वारा निर्धारित नियमों और विनियमों का पालन करें।
सामान्य क्षेत्रों या संपत्ति को नुकसान न पहुँचाएँ।
शिष्टाचार बनाए रखें और साथी निवासियों के अधिकारों का सम्मान करें।
सेवाओं के सुचारू संचालन के लिए समिति प्रबंधन को सहयोग करें।

7. दायित्व की सीमा

समिति सभी सूचीबद्ध सेवाओं को समय पर और कुशल तरीके से प्रदान करने के लिए उचित प्रयास करती है। हालाँकि, हमारे नियंत्रण से बाहर की परिस्थितियों के कारण सेवाएँ अस्थायी रूप से बाधित हो सकती हैं, जिसमें प्राकृतिक आपदाएँ, सरकारी आदेश, उपकरण विफलता, या आपूर्ति की कमी शामिल है लेकिन इन्हीं तक सीमित नहीं है। ऐसी बाधाओं से उत्पन्न किसी भी असुविधा या हानि के लिए समिति उत्तरदायी नहीं होगी।

8. संशोधन

समिति समय-समय पर इन शर्तों में संशोधन करने का अधिकार सुरक्षित रखती है। किसी भी परिवर्तन की सूचना निवासियों को उचित माध्यमों जैसे नोटिस बोर्ड, समिति बैठक, या इलेक्ट्रॉनिक संचार के माध्यम से दी जाएगी।

9. शासी कानून

ये शर्तें भारत के कानूनों, विशेष रूप से मध्य प्रदेश सहकारी समिति अधिनियम और अन्य लागू कानून के अनुसार शासित और व्याख्यायित होंगी। इन शर्तों से उत्पन्न कोई भी विवाद भोपाल, मध्य प्रदेश के न्यायालयों के विशेष अधिकार क्षेत्र के अधीन होगा।

10. भाषा अस्वीकरण

ये सेवा की शर्तें निवासियों की सुविधा के लिए अंग्रेज़ी और हिंदी दोनों में प्रदान की गई हैं। अंग्रेज़ी संस्करण और हिंदी संस्करण के बीच अर्थ में किसी भी विसंगति या अंतर की स्थिति में, अंग्रेज़ी संस्करण मान्य होगा और इसे आधिकारिक पाठ माना जाएगा।
